The Beatles will reportedly release “The Beatles Bootleg Recordings 1963,” a digital-only album of Beatles rare tracks exclusively to iTunes next week that will include studio outtakes and more songs recorded live for the BBC, a source with knowledge of the situation told Beatles Examiner Dec. 10.

The 59-track release, which has not been officially announced, will take place Dec. 17 and include 15 Beatles studio outtakes and 44 more live BBC tracks to add to those already on “Live at the BBC” and “On Air: Live at the BBC, Volume 2.” The album is to counter the recent non-EMI releases in Europe that have included Beatles tracks.

Maybe this is nit-picking, but somebody ought to re-count. There are 15 Beatles studio outtakes and just 42 more live BBC tracks. The other two are Lenmac demos of songs never officially recorded by the Beatles.

On a more important note, however, I wonder if this will be available in iTunes worldwide (assuming it comes out at all), or whether it will be a "Europe Only" release, as with Dylan's similarly motivated 50th Anniversary Copyright Protection releases?

There's a second thread addressing this that I just posted in. My frustration is that I tunes is lossy, & the legal "bootlegs" are lossless.

Well...the first Dylan EU copyright extension set sounded too good to be true, but was indeed true, and now there's been a second batch. I posted elsewhere that there is definitely a "use-it-or-lose-it" clause in the UK, in which performers on a recording can obtain the rights to that recording if the owner of that recording fails to release it within fifty years of creation, and I believe that the BBC, not EMI, owns the BBC material, and am guessing that these are the rest of the 1963 songs not yet released.

I'm more puzzled by the studio stuff--have these tracks been bootlegged at all? Have any other 1963 outtakes surfaced? My best guess is that this is designed to preserve the copyright in stuff already circulating, but unlike the Dylan sets, the stuff in the Beatle vault will apparently stay in the vault.

I want to look this up, but right now I'm in my last week of my last semester of school and am too exhausted.

The main one I've been hearing of is a 2 cd set with a brown cover called "I Saw Her Standing There" that has a lot of Tony Sheridan stuff & some Beatles. I haven't heard it.

There's a LOT more BBC performances from 1963. They performed over 200 tracks for the BBC just in 1963 (not all different songs, just different performances), and, to date, they've only released a little over 70 of them. This is just barely scratching the surface.

Several full reels of multi-tracks from the 11 February (tape #'s E48875 & E48877), 5 March (E49015 & E49016), & 12 September (E50527) sessions were "borrowed" from the archives back in the early 80's (and subsequently returned), all of which have been released in beautiful quality on bootlegs. That's the thing that kind of has me scratching my head about the 1963 Dylan set--there's a handful of actual studio outtakes, but not every single complete (no false start) unreleased studio performance, as with the 1962 set last year. I have a hunch that maybe there is one country over there with some odd loophole--at least one performance from each recording session for each performer in that session or some such thing. Broadcasts and live performance, like I was saying somewhere else, seem to operate a separate set of rules. "Transmissions" are a big deal in the UK--you have to buy a license to own a radio or a TV, needle time, equitable remuneration, etc. And people who taped the Beatles off the air back in the 60's were breaking the law--it's still against the law over there, I believe.

Yesterday (Dec. 13) we learned that the Beatles were putting out a set of 59 outtakes, demos and songs cut for the BBC. Today we learn that ‘The Beatles Bootleg Recordings 1963’ is being released on Tuesday (Dec. 17) in order for them to retain their copyrights.

The BBC is reporting that a 2011 change to European copyright law is responsible for the band’s decision to make these tracks available, even though it directly competes with their ‘On Air: Live at the BBC Volume 2’ double-album that came out last month, and a box of their U.S. Capitol albums to hit stores in January. According to a “Use It or Lose It” provision in the new law, the copyrights to unreleased tracks expire 50 years after they were recorded. ‘The Beatles Bootleg Recordings 1963’ will extend the Beatles’ rights to these songs through 2033.

Given the considerable lack of hype surrounding this release, it is believed that this new set, which is exclusive to iTunes, will only be sold for a brief spell. This will buy the Beatles some time in figuring how to properly market these, and other tracks in their vaults facing a similar fate, in the future.

Earlier this year, Bob Dylan released a similar compilation of 86 outtakes from 1962. Only 100 copies were pressed and sold in a few European countries.
