So I'm on ebay and I see a seller listing "The Very Best Of Pablo Cruise" with a picture I have never seen before. Wasn't a scan of the cd itself. Seller had a 100% rating on 86 ratings the last 12 months, 2655 total ratings. So 8 bids later, including mine, I win it at $21. I receive the cd yesterday and it is the "20th Century Millennium Collection." That ain't what he pictured, if he had, nobody would have bid on it and nobody would have bid $21, least of all me, because I already own it. His return policy states that he accepts returns within 7 days for a refund and pays return shipping costs as well. I email him asking him for his return address because I can't read his scribbling on the envelope and why I was returning it. He responds today by saying that he listed it correctly and that, even though he "doesn't usually do this", that he's "willing" to refund half of my purchase price. My response to him was that right now on ebay, Pablo Cruise has 35 cds listed, 12, or 1/3 of the total listings, are the 20th Century release and all have that picture. 20th Century lists their releases as "The Best Of...."--this guy listed his as "The Very Best Of...." with a totally different picture, hence, 8 bids, including my winning one. I sell mainly on amazon and have made mistakes, we all do, just own up to it and take of the buyer. Don't insult my intelligence by thinking anyone would pay $21 for a 20th Century release when a dozen of them are on the same page for six bucks, and then compound that by trying to tell me that you listed it correctly and didn't misrepresent it. I'm going to leave this guy a negative rating regardless of what he does now, I would not have if he had just apologized after my first email. He says he doesn't want the cd back. I'm waiting for his next response before I file a claim through ebay. That's just a terrible seller.

Open a complaint with PayPal that the title was misleading and it was not the CD that was described. Its a case you will certainly win . They will definitely refund your money.

I'm going to wait for his second reply first and if he doesn't reply in 24 hours then I'll go through PayPal.

1. The problem is likely caused by ebay. Their "pre-filled listing information" is fucked up beyond belief & has been since day 1. Personally having 3600+ listings, I often miss these ebay mistakes also.

2. That said, I agree; file a claim. You can file through ebay or through Pay Pal. As a seller, I'd almost always rather have you file with Pay Pal as they are much easier for sellers to work with. So if you are angry & want to maximize the difficulty for the seller, i suspect filing through ebay would be the way to go.

And don't worry, I have NEVER heard of a buyer losing a not as described "case". (I HATE the words "case" & "dispute", I really wish ebay would choose less emotionally loaded phrases.) in fact one Pay Pal rep told me a couple years back that a buyer can not lose a not as described unless they refuse to return the item & even then it's iffy........

The bad news is you probably will get stuck with return postage.

Even though his stated return policy is that he will pay for return postage? No biggie, it will only be about 2 bucks and change.

Those stated return policies are a joke, as ebay doesn't allow the seller to enforce them. Mine states that I will never refund international shipping, but ebay has told me it does not matter that I've stated that, I'm required to do so. And they REQUIRE us to post that worthless return policy.............

The seller responded today saying he still didn't misrepresent it, even though any seller, right now, can go on ebay and just list either HALF of the UPC code or type in P-A-B, and the correct picture pops up in ebay's database. Says now he will take the cd back but won't refund my shipping charges because I got a "Best Of" Pablo Cruise in mint condition, just like he said. Nevermind the totally different picture that garnered him 8 bids and $21 when 12 other sellers currently have it right and are selling it for 6 bucks, which is moot because I already own it. Just left him the worst feedback I possibly could in the 120 characters or whatever allowed and filed a claim under the ebay buyer protection.

IMO, right now ebay is a lose-lose for everyone except their stockholders & employees.

Unfortunately for us sellers, Amazon isn't much better & they hold our $'s for 2 weeks +, as does Albiris.

Internet sales have become mostly corporate (surprise) & us little guys are getting locked out.

Thought I'd provide the ending to this saga for those with any interest. I filed a claim, the seller waited 6 days before responding, then did so today by still claiming that I received exactly what he described and to further lie, stated that I had refused a refund if I returned it. My first email to him was asking for his return address so I could return it. I had refused his offer of a HALF refund. So after lighting him up with my reply, I escalated the case to ebay for resolution. I barely had clicked on the button to confirm that I wanted to escalate it when ebay replied that I had been refunded $25.50. I can understand if this seller was a 97% or had some negative feedback, but he was 100% with none (until mine.) So. job well done ebay.
