Anyhoo, I trust Grohl and Novoselic's opinion more than Love's. Okay? "Dave Grohl and Krist Novoselic are "dismayed and disappointed" in the Kurt Cobain avatar to be featured in the upcoming Guitar Hero 5 game, and today the two former Nirvana members issued a strongly worded statement regarding the situation."

No proof, but you don't have proof he'd object, so it leaves the whole thing as something no one can know either way. That said, it didn't seem that he minded his image being used commercially during the whole Beatles craze, so I don't know why he'd object suddenly to video games.

I think it's a good idea for Rock Band to side with the artists or they may find themselves competing with somebody else who does or at least losing artists willing to work with them. Why wouldn't they just say, "Sorry, we didn't know Nirvana would object, on the next set of releases we'll lock Cobain's image"?

Rock Band is the competition; Guitar Hero is the one that pissed off Nirvana.
And yes, I agree with you, Guitar Hero could lose a lot of artists to Rock Band over this.

It's a shame that his estate (i.e. Courtney Love) placed the almighty dollar above what he very likely would have wanted. See also, the Converse sneaker thing earlier in this thread. Well, you may be right, however you never knew Kurt-- Courtney did. You're assuming that you know what he'd want over his wife. I'll flip that back at you, then -- what in Cobain's public history makes you think he would want to become a video game character?

Dave Grohl reveals he asked PJ Harvey to front Nirvana reunionFrontman says there's a "good reason" why Foo Fighters don't play Nirvana songs http://www.nme.com/news/dave-grohl/69312Dave Grohl has revealed that he asked PJ Harvey to join the remaining Nirvana members on stage to replace Kurt Cobain. Speaking in this week's NME, which is on newsstands from today or available digitally, the Foo Fighters frontman said that he approached Harvey to play with his Sound City players – the band featured in his documentary about the California studio where Nirvana recorded Nevermind. When asked if he would ever cover a Nirvana track live, he said: "Every once in a while we talk about it. For the Sound City gig here in London we were thinking about musicians that we could invite because Stevie Nicks and John Fogerty couldn't make it. Someone came up with the idea of doing a Nirvana song with PJ Harvey. Kurt loved her and we love her and we thought, 'Yeah, what would we do?' I said: 'God, what if we were to do 'Milk It' from In Utero with Polly singing?' We all looked at each other like, 'Woah, that would be amazing…' and then she couldn't do it!" He continued: "The thing is, it's sacred ground. If we were ever to do something like that it would have to be right because you want to pay tribute. There's a reason Foo Fighters don't do Nirvana songs, and it's a good reason."

If Pj Harvey cut a couple cover tracks with the remaining members of Nurvana it would be very interesting.

That and being a baby (pun intended). I hope he loses and has to pay all court costs. It's naked* opportunism. He's been making money recreating the photo for years. That said, he might have a case: Quote: “Neither Spencer nor his legal guardians ever signed a release authorizing the use of any images of Spencer or of his likeness,” the documents further state. It wouldn't surprise me in the least if this was true. When I produced music videos, I diligently collected releases from actors and locations, and out of the musicians, management, production companies and labels, not a single entity involved wanted them when shooting was done. I ended up throwing everything out when I moved a few years ago. Not that anybody cares at the bottom where I was feeding, but actors and cinematographers involved ultimately retained all rights to their image and performances, and could block any further commercial exploitation if they felt like. The director came out of it owning the copyright to his editorial timelines and nothing else. *Hiyo!

In the 'past' people used to trust and respect each other, it's people like this dude who is doing his best to destroy all of this and create an even more paranoid world. I meet a few from time to time unfortunately and even came across one today on my ebay store who basically lied through his teeth and destroyed the trust.

He embraced being the "Nirvana baby" for decades, using it as a pickup line, getting "Nevermind" tattooed on his chest, and as noted recreating it himself. Now he sees an opportunity for cash and is going for it. A cover like that wouldn't fly in this day and age admittedly, but he's had NO problem with it up until now, and in fact quite the opposite. That's where this falls apart, and I hope he doesn't get a dime.
